Madame Sheila Malcolmson, ministre de la Sant\u00e9 mentale et des D\u00e9pendances de la Colombie-Britannique<\/p>\n\n<p class=\"wp-block-paragraph\">Madame la Ministre Bennett et Monsieur le Ministre Duclos,<\/p>\n\n<p class=\"wp-block-paragraph\">Re : Un seuil cumulatif propos\u00e9 de 4,5 grammes en Colombie-Britannique<\/p>\n\n<p class=\"wp-block-paragraph\">Nous sommes une coalition de plus de 20 organisations de la soci\u00e9t\u00e9 civile au Canada, repr\u00e9sentant des personnes qui consomment de la drogue et leurs familles, des groupes autochtones et d\u2019autres groupes racialis\u00e9s, des fournisseurs de services, des organisations juridiques, des groupes de recherche et des militants de la politique en mati\u00e8re de drogues. Nous avons pour objectif d\u2019abolir les lois p\u00e9nales et autres lois, ainsi que les politiques et pratiques qui contr\u00f4lent, stigmatisent, pathologisent et punissent les personnes qui consomment de la drogue.<\/p>\n\n<p class=\"wp-block-paragraph\">Nous sommes conscients que Sant\u00e9 Canada \u00e9value pr\u00e9sentement la demande de la Colombie-Britannique pour obtenir une exemption \u00e0 la Loi r\u00e9glementant certaines drogues et autres substances en vue de d\u00e9criminaliser la possession simple jusqu\u2019\u00e0 une quantit\u00e9 seuil cumulative de 2,5 grammes. Cette quantit\u00e9 est d\u00e9j\u00e0 un seuil cumulatif consid\u00e9rablement trop bas pour de nombreuses personnes qui consomment des drogues\u2009; elle a \u00e9t\u00e9 rejet\u00e9e \u00e0 la quasi-unanimit\u00e9 par la \u00ab\u2009Core Planning Table on Decriminalization\u2009\u00bb de la Colombie-Britannique.<\/p>\n\n<p class=\"wp-block-paragraph\">Honorables ministres : un seuil cumulatif de 2,5 grammes ne repose sur aucune justification l\u00e9gale ou probatoire. En accord avec la recommandation de notre plateforme de 2021, nous vous prions de refuser cette quantit\u00e9 et de renoncer compl\u00e8tement aux quantit\u00e9s seuils.<\/p>\n\n<p class=\"wp-block-paragraph\">Nous vous avons communiqu\u00e9 \u00e0 plusieurs reprises le risque important associ\u00e9 \u00e0 la fixation d\u2019un seuil qui ne refl\u00e8te pas les habitudes de consommation r\u00e9elles. Les march\u00e9s de la drogue se conformeront \u00e0 ce seuil bas, en modifiant par exemple la puissance et les quantit\u00e9s de drogues disponibles ou vendues, ce qui pourrait augmenter le risque de surdose. Les autres effets n\u00e9fastes d\u2019un seuil de 2,5 grammes sont notamment le renforcement des interactions avec le march\u00e9 non r\u00e9glement\u00e9, alors que les personnes essaient d\u2019\u00e9viter la criminalisation en achetant r\u00e9guli\u00e8rement de plus petites quantit\u00e9s. Les groupes les plus affect\u00e9s par un seuil bas seront les communaut\u00e9s noires, autochtones et autres communaut\u00e9s racialis\u00e9es, marginalis\u00e9es et d\u00e9favoris\u00e9es, qui sont victimes de discrimination et qui sont arr\u00eat\u00e9es et incarc\u00e9r\u00e9es de mani\u00e8re disproportionn\u00e9e pour des infractions li\u00e9es \u00e0 la drogue.<\/p>\n\n<p class=\"wp-block-paragraph\">Un seuil de 2,5 grammes est en contradiction avec l\u2019engagement de votre gouvernement en faveur d\u2019une politique des drogues fond\u00e9e sur des preuves, de la lutte contre le racisme et pour la r\u00e9conciliation avec les communaut\u00e9s autochtones. Cette mesure ne respecte pas les recommandations formul\u00e9es par la Core Planning Table de la Colombie-Britannique et favorise les demandes non justifi\u00e9es de la police, fond\u00e9es sur la stigmatisation. Nous savons que Sant\u00e9 Canada a rencontr\u00e9 la police lors de son processus de prise de d\u00e9cision, tandis que les demandes de groupes dirig\u00e9s par des personnes qui consomment des drogues, comme le \u00ab\u2009Vancouver Area Network of Drug Users\u2009\u00bb (VANDU), ont \u00e9t\u00e9 enti\u00e8rement ignor\u00e9es.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Il faut r\u00e9ussir la d\u00e9criminalisation.<\/strong> Il vous incombe, sur les plans moral, juridique et \u00e9thique, de faire respecter les droits fondamentaux des personnes qui consomment de la drogue\u2009; pour ce faire, il est indispensable que vous mettiez l\u2019accent sur leur expertise.
