{"id":1347,"date":"2012-02-23T19:25:51","date_gmt":"2012-02-23T19:25:51","guid":{"rendered":"https:\/\/drugpolicy.ca\/?p=1347"},"modified":"2016-03-01T21:52:04","modified_gmt":"2016-03-01T21:52:04","slug":"la-justice-reparatrice-une-alternative-au-projet-de-loi-c-10","status":"publish","type":"post","link":"https:\/\/new.drugpolicy.ca\/fr\/la-justice-reparatrice-une-alternative-au-projet-de-loi-c-10\/","title":{"rendered":"La justice r\u00e9paratrice : Une alternative au projet de loi C-10"},"content":{"rendered":"<p><strong>Hier soir, le juge retrait\u00e9 du Yukon Barry Stuart, un ardent d\u00e9fenseur de la <a href=\"http:\/\/%20http\/\/www.csjr.org\/\" target=\"_blank\">justice r\u00e9paratrice <\/a>, a tenu un dialogue au sujet du projet de loi C-10 dans une salle de comit\u00e9 dans l\u2019\u00e9difice du Centre sur la colline du Parlement \u00e0 Ottawa.<\/strong><\/p>\n<p>Parmi les participants se trouvaient des repr\u00e9sentants de la Soci\u00e9t\u00e9 John Howard du Canada, l\u2019Arm\u00e9e du Salut, l\u2019Association des m\u00e8res somaliennes, les Victimes d\u2019actes criminelles, Penal Reform International et d\u2019autres organisations et individus qui ont une exp\u00e9rience personnelle avec les \u00e9tablissements correctionnels et le syst\u00e8me de justice p\u00e9nale. <a href=\"http:\/\/www.parl.gc.ca\/SenatorsMembers\/Senate\/SenatorsBiography\/isenator_det.asp?senator_id=2773&amp;Language=F\" target=\"_blank\">Le s\u00e9nateur James Cowan<\/a>, membre du Comit\u00e9 s\u00e9natorial permanent des affaires juridiques et constitutionnelles, y \u00e9tait aussi pr\u00e9sent.<\/p>\n<p>Avec plus de 30 personnes pr\u00e9sentes, chaque commentaire et sujet soulev\u00e9 par les participants aurait pu entra\u00eener toute une discussion d\u2019eux-m\u00eames. Cependant, quatre th\u00e8mes cl\u00e9s ont \u00e9merg\u00e9 lors de la soir\u00e9e.<\/p>\n<p>M. Stuart et Eva Marszewski, de <a href=\"http:\/\/www.peacebuildersinternational.com\/\" target=\"_blank\">Peacebuilders International Canada<\/a>, ont d\u00e9marr\u00e9 la discussion en parlant du besoin d\u2019impliquer les communaut\u00e9s dans les enjeux li\u00e9s \u00e0 la justice. Mme Marszewski a expliqu\u00e9 comment Peacebuilders ont cr\u00e9\u00e9 un programme pilote qui am\u00e8ne les d\u00e9linquants \u00e0 participer dans les cercles de discussion avec les membres de la communaut\u00e9. Ceci permet \u00e0 la communaut\u00e9 de d\u00e9cider ce que devrait faire le d\u00e9linquant afin de r\u00e9parer ses torts et de rendre des comptes. Ce projet a si bien r\u00e9ussi que les tribunaux provinciaux ont enti\u00e8rement financ\u00e9 un bureau pour leur travail au centre-ville de Toronto.<\/p>\n<blockquote><p>Barry Stuart a ajout\u00e9 aux points de Mme Marszewski en disant que 75% de sa charge de travail quand il \u00e9tait juge aurait pu \u00eatre trait\u00e9 \u00e0 bien meilleur march\u00e9 par des experts de la sant\u00e9 et membres de la communaut\u00e9 concern\u00e9e.<\/p><\/blockquote>\n<p>Un des th\u00e8mes de la soir\u00e9e portait sur la d\u00e9mocratie participative qui, selon M. Stuart, vise \u00e0 \u00ab cr\u00e9er un lieu s\u00fbr pour permettre \u00e0 une communaut\u00e9 de faire le travail pour en faire une communaut\u00e9 \u00bb. Il y avait certes plusieurs personnes \u00e0 la table qui avouaient ne pas \u00eatre experts dans cette approche; toutefois, M. Stuart a r\u00e9p\u00e9t\u00e9 qu\u2019il s\u2019agit d\u2019un enjeu pour la soci\u00e9t\u00e9 civile, <a href=\"https:\/\/drugpolicy.ca\/fr\/solutions-innovatrices-2\/politiques-cl%C3%A9s\/promouvoir-les-droits-de-la-personne-internationaux\/\" target=\"_blank\">un enjeu des droits de la personne <\/a>, et que tous poss\u00e8de une expertise dans la compr\u00e9hension humaine.<\/p>\n<p>Un autre th\u00e8me de la soir\u00e9e fut la \u00ab d\u00e9pendance \u00e0 la punition \u00bb, tel que nomm\u00e9 par un repr\u00e9sentant de l\u2019\u00c9glise Unie. L\u2019id\u00e9e que l\u2019incarc\u00e9ration est \u00e9quitable \u00e0 la vengeance de la victime semble \u00eatre enracin\u00e9e dans les valeurs et les syst\u00e8mes de croyance de beaucoup de citoyens. Mais comme certains l\u2019ont fait remarquer, les victimes sont souvent simplement \u00e0 la recherche d\u2019une prise de responsabilit\u00e9, et ne voient pas d\u2019autre alternative au syst\u00e8me de justice p\u00e9nale. Pourtant, de nombreux partisans de peines plus s\u00e9v\u00e8res ne sont pas conscients des m\u00e9thodes alternatives, telle que <a href=\"http:\/\/www.publicsafety.gc.ca\/res\/cor\/rep\/cprfe-rpcqe-fra.aspx#toc-04\" target=\"_blank\">l\u2019approche Gladue <\/a>, qui \u00e0 la fois \u00e9conomise de l\u2019argent et r\u00e9duit le r\u00e9cidivisme.<\/p>\n<p>Dans l\u2019ensemble, il a \u00e9t\u00e9 convenu qu\u2019une conversation difficile, n\u00e9buleuse et moralement difficile se concentrant sur le but du syst\u00e8me de justice devrait \u00eatre entam\u00e9e. Cet effort devrait viser \u00e0 comprendre ce qu\u2019est la vraie justice, ce que sont les effets des crimes et ce qui motive les d\u00e9linquants.<\/p>\n<p>Le plus grand th\u00e8me de la discussion fut<a href=\"http:\/\/www.cbc.ca\/thecurrent\/interviews\/2012\/01\/11\/judge-barry-stuart-on-bill-c-10\/\" target=\"_blank\">les probl\u00e8mes que cr\u00e9era le projet de loi C-10. <\/a>Des enjeux tels que les craintes relatives \u00e0 la surpopulation carc\u00e9rale, un syst\u00e8me de justice encore plus bouch\u00e9, des coupures budg\u00e9taires aux communaut\u00e9s et aux programmes de pr\u00e9vention d\u00e9j\u00e0 inad\u00e9quats, la pression croissante \u00e0 Ottawa en faveur de la privatisation des prisons, ainsi que comment les victimes et d\u00e9linquants deviendront davantage victimes plus les coupures financi\u00e8res r\u00e9duiront l\u2019acc\u00e8s \u00e0 la justice, ont tous \u00e9t\u00e9 discut\u00e9s.<\/p>\n<p>Il n\u2019y avait pas beaucoup d\u2019optimisme dans l\u2019air, puisque le projet de loi C-10 est presqu\u2019assur\u00e9 de passer et de commencer \u00e0 contribuer directement \u00e0 ces probl\u00e8mes. Cependant, cette discussion a aussi men\u00e9 au dernier th\u00e8me de la soir\u00e9e : l\u2019unit\u00e9.<\/p>\n<p>L\u2019\u00e9norme quantit\u00e9 de probl\u00e8mes que tant de groupes entretiennent avec le projet de loi C-10 a sembl\u00e9 unir les gens. Beaucoup de militants de longue date ont estim\u00e9 que m\u00eame il y a cinq ans, un tel groupe diversifi\u00e9 de personnes et d\u2019organisations ne serait pas ensemble dans la m\u00eame pi\u00e8ce. M. Stuart a d\u00e9crit \u00e0 quel point il \u00e9tait tann\u00e9 que tout ces groupes se rencontrent dans une salle, se font remonter le moral, et ensuite retournent \u00e0 leurs communaut\u00e9s respectives. M.
