Telle fut la conclusion de plus de <a href=\"http:\/\/supervisedinjection.vch.ca\/research\/\">30 \u00e9tudes de recherche<\/a> sur le centre d\u2019injection supervis\u00e9e (CIS) de Vancouver, Insite. Et la Cour supr\u00eame du Canada a exprim\u00e9 son accord en septembre 2011, et ordonn\u00e9 \u00e0 la ministre f\u00e9d\u00e9rale de la Sant\u00e9 d\u2019accorder une exemption en vertu de l\u2019article 56 de <em>la<\/em><em>Loi r\u00e9glementant certaines drogues et autres substances<\/em> pour permettre \u00e0 Insite de poursuivre ses activit\u00e9s.<\/p>\n<p>Pour accro\u00eetre la r\u00e9duction des m\u00e9faits et soutenir le d\u00e9veloppement de services semblables dans toute la province, le minist\u00e8re de la Sant\u00e9 de la C.-B. a r\u00e9vis\u00e9 son \u00ab\u00a0<a href=\"http:\/\/www.health.gov.bc.ca\/cdms\/harmreduction.html\">Guidance Document for Supervised Injection Services<\/a>\u00a0\u00bb. R\u00e9dig\u00e9 \u00e0 l\u2019intention des professionnels de la sant\u00e9, il offre des conseils aux autorit\u00e9s sanitaires et \u00e0 d\u2019autres organisations qui envisagent d\u2019offrir des services d\u2019injection supervis\u00e9e dans leur localit\u00e9.<\/p>\n<p>Selon la politique provinciale, quiconque d\u00e9sire offrir ce service devra examiner comment il obtiendra le soutien des groupes locaux comme les m\u00e9decins hygi\u00e9nistes, les services de police et autres groupes \u00e9ventuellement concern\u00e9s. La d\u00e9cision de la Cour supr\u00eame du Canada mentionne bri\u00e8vement les futures applications de l\u2019exemption en vertu de l\u2019article 56\u00a0:<\/p>\n<p><em>[153]<\/em><em>\u00a0<\/em><em>La\u00a0Loi\u00a0accorde au ministre le pouvoir discr\u00e9tionnaire de d\u00e9cider s\u2019il faut accorder ou non une exemption.\u00a0Ce pouvoir discr\u00e9tionnaire doit \u00eatre exerc\u00e9 en conformit\u00e9 avec la\u00a0Charte. Le ministre doit donc se demander si le refus d\u2019une exemption porterait atteinte aux droits \u00e0 la vie et \u00e0 la s\u00e9curit\u00e9 des personnes autrement qu\u2019en conformit\u00e9 avec les principes de justice fondamentale.\u00a0Les facteurs pris en compte pour rendre une d\u00e9cision relativement \u00e0 une exemption doivent comprendre la preuve, si preuve il y a, concernant l\u2019incidence d\u2019un tel centre sur le taux de criminalit\u00e9, les conditions locales indiquant qu\u2019un centre d\u2019injection supervis\u00e9e r\u00e9pond \u00e0 un besoin, la structure r\u00e9glementaire en place permettant d\u2019encadrer le centre, les ressources disponibles pour voir \u00e0 l\u2019entretien du centre et les expressions d\u2019appui ou d\u2019opposition de la communaut\u00e9.<\/em><\/p>\n<p>&nbsp;<\/p>\n<p>Cette derni\u00e8re phrase a soulev\u00e9 des questions quant \u00e0 la probabilit\u00e9 du succ\u00e8s des futurs services de consommation supervis\u00e9e. Malgr\u00e9 les preuves \u00e9crasantes de leur succ\u00e8s, les services de r\u00e9duction des m\u00e9faits font toujours l\u2019objet de controverses publiques, ce qui veut dire que des membres de la communaut\u00e9 vont probablement s\u2019objecter \u00e0 des services de consommation supervis\u00e9e. Mais l\u2019existence de cette opposition ne signifie pas n\u00e9cessairement que les demandeurs \u00e9ventuels doivent cesser leurs efforts. En fait, le jugement de la Cour supr\u00eame n\u2019est pas une liste des crit\u00e8res d\u2019une demande r\u00e9ussie mais plut\u00f4t, une description des facteurs que le ministre doit prendre en compte pour d\u00e9cider. Les demandeurs \u00e9ventuels doivent \u00eatre en mesure de d\u00e9montrer qu\u2019ils ont sond\u00e9 le soutien public et peuvent prouver qu\u2019il existe. Les demandes, comme le sugg\u00e8re le gouvernement provincial de la C.-B., doivent comporter des preuves tant du soutien que de l\u2019opposition.<\/p>\n<p>Il faut se rappeler qu\u2019Insite n\u2019a pas n\u00e9cessairement d\u00e9marr\u00e9 avec le soutien de la communaut\u00e9 au complet. C\u2019est plut\u00f4t avec le temps, et avec la continuit\u00e9 des activit\u00e9s du centre que la communaut\u00e9 avoisinante a ressenti ses effets positifs et que les chercheurs ont pu en d\u00e9monter l\u2019efficacit\u00e9 en ce qui concerne la sant\u00e9 et l\u2019ordre social. Cela ne signifie pas que si un groupe s\u2019objecte, alors la demande sera n\u00e9cessairement non re\u00e7ue.
